Around 8:30 p.m., Benjamin and his father, Elvis Zepeda, were standing on the west shoulder of SR-33 near a food truck when the toddler suddenly darted into the road. Elvis chased after his son, but despite his efforts, Benjamin was struck by a northbound BMW. Emergency responders arrived quickly at the scene, and Benjamin was transported to Doctors Medical Center. Unfortunately, he succumbed to his injuries and passed away shortly afterward.

The Aftermath: Father’s Actions Lead to Arrest

After the accident, the driver of the BMW immediately stopped, but Elvis Zepeda, in a state of extreme distress, retrieved a handgun and fired multiple shots at the car, striking its rear. The driver, unharmed, fled the scene.

Following the incident, the California Highway Patrol (CHP), along with the Stanislaus County Auto Theft Task Force, gathered evidence and identified Elvis Zepeda as the shooter. He was arrested and booked into the Stanislaus County Public Safety Center on charges including attempted murder, possession of an illegal firearm, and possession of a controlled substance.
